1. Acceptance of Terms
By accessing and using Behind Me ("the App"), you accept and agree to be bound by the terms and conditions of this agreement. If you do not agree to these terms, please do not use the App.
2. Description of Service
Behind Me is a photo editing application that provides the following features:
- Text-behind-object effects on photos
- Custom font import and stylish font options
- Color and gradient color application to text
- Shadow effects for text
- Stroke effects and hollow text options
- Selective text sizing and coloring (attributed text)
3. License Grant
3.1 Limited License
We grant you a limited, non-exclusive, non-transferable, revocable license to use Behind Me for personal, non-commercial purposes on iOS devices that you own or control.
3.2 Restrictions
You may not:
- Copy, modify, or distribute the App
- Reverse engineer, decompile, or disassemble the App
- Remove any copyright or proprietary notices from the App
- Use the App for any commercial purposes without written permission
- Attempt to gain unauthorized access to the App's code or systems
4. User Responsibilities
4.1 Photo Ownership
You represent and warrant that:
- You own or have the necessary rights to all photos you edit using the App
- Your use of photos does not violate any third-party rights
- You will not use the App to create content that is illegal, harmful, or infringes on others' rights
4.2 Prohibited Uses
You agree not to use Behind Me to:
- Create or distribute illegal, defamatory, or offensive content
- Infringe on intellectual property rights, including copyrights and trademarks
- Harass, abuse, or harm others
- Impersonate any person or entity
- Distribute malware or harmful code
5. Intellectual Property Rights
5.1 App Ownership
Behind Me, including its original content, features, functionality, text-behind-object algorithm, and design, is owned by the developer and is protected by international copyright, trademark, and other intellectual property laws.
5.2 Your Content
You retain all ownership rights to photos you edit using Behind Me. We do not claim any ownership over your photos or edited content. You are solely responsible for your edited content.
5.3 Fonts
Custom fonts imported into the App must be properly licensed by you. We are not responsible for any licensing violations related to user-imported fonts.
6. Disclaimer of Warranties
Behind Me is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied, including but not limited to:
- Fitness for a particular purpose
- Non-infringement
- Uninterrupted or error-free operation
- Accuracy or reliability of results
We do not guarantee that the App will meet your requirements or that it will be compatible with all devices.
7. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of data or photos
- Loss of use or profits
- Device damage
- Business interruption
Our total liability shall not exceed the amount you paid for the App (if any).
8. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights, including copyright and privacy rights
9. Updates and Changes
9.1 App Updates
We may release updates, bug fixes, and new features from time to time. You may need to update the App to continue using it.
9.2 Terms Updates
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the App after changes constitutes acceptance of the modified Terms.
10. Termination
We may terminate or suspend your access to Behind Me immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the App will cease immediately.
You may terminate this agreement by deleting the App from your device.
11. Third-Party Content
The App may allow you to import custom fonts and use various styling features. You are responsible for ensuring you have proper rights and licenses for any third-party content you use with the App.
12. Privacy
Your use of Behind Me is also governed by our Privacy Policy. Please review our Privacy Policy to understand how we handle your information.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.
14. Dispute Resolution
Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with Indian arbitration rules.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
16. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the use of Behind Me.
